1. Agreement Overview
By purchasing and enrolling in Live Your Dream Club, you agree to these Terms and Conditions, along with the Privacy Policy and Code of Conduct. These agreements form a binding legal contract between you and Live Your Dream Club (“we,” “us,” or “the Club”). Please read this carefully before completing your purchase.
2. Eligibility
You must be at least 18 years old to enroll in Live Your Dream Club. If you are under the age of 18, you must have the consent of your parent or legal guardian to enroll in this program.
3. Membership Commitment
As a Founding Member, your membership is a one-year commitment. The membership duration is intentionally set to ensure consistent progress toward your dreams. By enrolling, you agree to remain committed to the full term and acknowledge that you cannot cancel or receive a refund within the first year.
- No Refund Policy: Refunds or cancellations are not allowed during your first year of membership. After one year, you may choose to cancel your membership at the end of the term, but you will not be able to rejoin at the exclusive Founding Member rate.
- Membership Rate: The membership rate has been set at a special rate to make this a valuable yet accessible investment for your growth.
- Automatic Renewal: The membership will automatically renew at the end of the subscription term unless cancelled by you before the renewal date. Notice of the renewal and any changes to the terms or pricing will be provided in advance.
4. Code of Conduct
As a member, you agree to engage with other members in a respectful, kind, and supportive manner. Disrespectful behavior, harassment, or any form of disruptive activity will not be tolerated. We reserve the right to remove any member at our sole discretion for failure to adhere to these expectations.
- Zero Tolerance for Harassment: Any form of harassment, discrimination, or offensive behavior will result in immediate removal from the Club.
- Respectful Community: Members are expected to support each other, share their experiences positively, and help foster a welcoming environment for everyone.
5. Physical Activity Disclaimer
By participating in any optional in-person activities offered through Live Your Dream Club (such as live workshops, parties or other in-person sessions), you acknowledge that there are inherent risks involved, including but not limited to injury. You agree that you are participating voluntarily and assume all responsibility for any injuries or harm that may occur. You confirm that you are physically fit to engage in such activities.
- Waiver: You agree to release Live Your Dream Club and its affiliates from any liability for injuries or damages incurred while participating in physical activities.
6. Payment Terms
- Full Payment Commitment: You agree to pay for the full membership term at the time of enrollment.
- Payment Plan: You understand that there are no payment plans available.
- Missed Payments: If a payment is missed, your account may be marked as delinquent, and access to Live Your Dream Club will be revoked until the payment is made in full.
7. Intellectual Property
- Content Ownership: All content provided through Live Your Dream Club, including videos, articles, and resources, is owned by Live Your Dream Club and protected by intellectual property laws. You are granted a non-commercial, personal license to access the content.
- No Duplication: You may not reproduce, share, distribute, or modify any content from Live Your Dream Club without prior written consent. Any unauthorized use of the content will be subject to legal action.
8. Dispute Resolution and Legal Terms
- Binding Arbitration: Any disputes or claims arising out of or relating to this agreement will be resolved by binding arbitration in accordance with the laws of the State of New York.
- Class Action Waiver: You waive your right to participate in any class action lawsuit, and any dispute will be handled individually.
9. Termination of Membership
We reserve the right to terminate your membership at our sole discretion for any reason, including failure to comply with the Code of Conduct or any other violations of these Terms and Conditions.
10. Limitation of Liability
Live Your Dream Club is not liable for any indirect, incidental, or consequential damages arising out of your participation in the program. The Club’s total liability is limited to the amount paid for the membership.
11. Privacy and Confidentiality
Live Your Dream Club values your privacy and is dedicated to protecting your personal information. We do not knowingly collect personal information from individuals under the age of 13. If we suspect that a participant is under 13, we reserve the right to request proof of age to confirm eligibility.
As a member, you agree to uphold the privacy and confidentiality of the Club, including the following obligations:
- Respect for Participant Privacy: You must respect the intellectual property and privacy rights of both Live Your Dream Club and fellow members. Any confidential information shared within the Club, whether by the Club or other participants, remains the property of the disclosing party.
- Non-Disclosure Agreement: You agree not to disclose, share, or use any confidential information obtained through the Club for purposes other than your participation in its activities, unless explicitly authorized in writing by the disclosing party.
- Content Protection: All resources, tools, training materials, and other content shared by the Club are protected under intellectual property laws. You are granted limited, personal, non-commercial use of these materials in accordance with this Agreement. Unauthorized reproduction, distribution, or commercial use is strictly prohibited.
- Confidentiality Breach: Any violation of this confidentiality agreement, including unauthorized disclosure or misuse of information, may result in legal action by Live Your Dream Club, including but not limited to injunctive relief and damages.
You are encouraged to share your own results and personal achievements from the Club. However, you are strictly prohibited from sharing other members’ experiences, personal information, or statements—whether written or verbal—outside of the Club.
12. Third-Party Materials and Websites
Live Your Dream Club may provide links to third-party materials or websites for your convenience. These resources are not part of the Club’s offerings and are subject to separate terms and conditions established by the respective third parties.
- Independent Resources: The Club is not responsible for the content, products, or services provided by third-party materials or websites. You acknowledge that your use of these links is entirely at your own risk, and you assume full responsibility for any obligations, payments, or consequences arising from their use.
- No Warranties: The Club does not guarantee the accuracy, reliability, or quality of any third-party materials or websites and will not be held liable for any issues resulting from your access to or reliance on these resources.
- Respect for Rights: By using third-party materials or websites, you agree not to infringe upon the rights of others, including intellectual property rights, and to comply with all applicable laws and regulations.
Please exercise discretion and review the terms and conditions of any third-party resources before engaging with them.
13. Disclaimer
Live Your Dream Club and all related content are provided on an “as is” and “as available” basis. The Club makes no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement of third-party rights.
- No Guarantees of Results: While the Club strives to accurately represent the potential benefits of participation, specific results cannot be guaranteed. Your success depends on factors unique to you, including your skills, effort, commitment, circumstances, and external factors beyond our control.
- Personal Responsibility: By enrolling in Live Your Dream Club, you acknowledge that you are fully responsible for your own progress, actions, and outcomes. The Club does not guarantee financial success, audience growth, business achievements, or any other specific results.
- Testimonials: Any testimonials or endorsements from past or current members reflect individual experiences and are not promises or guarantees of future outcomes.
- Educational Content Only: The Club does not offer professional advice in legal, medical, psychological, financial, or other professional fields. All content, resources, and materials provided through the Club are for educational and informational purposes only and should not be considered a substitute for professional advice.
By participating in Live Your Dream Club, you agree to take full responsibility for your decisions and actions based on the information and resources provided.
14. Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of New York, United States of America. Any disputes between you and Live Your Dream Club, or regarding the validity, interpretation, or legal effect of this Agreement, will be resolved under New York law, without regard to its conflict of law principles.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Live Your Dream Club, its owners, officers, employees, affiliates, contractors, or licensees shall not be liable for any indirect, consequential, incidental, special, exemplary, or punitive damages arising from your use of the Club or participation in its programs.
Your sole remedy for dissatisfaction with the Club or any services provided is to discontinue using the services and, if applicable, request a refund as outlined in the refund policy.
While the Club takes reasonable precautions to protect your personal information, submitting such information is done at your own risk, as detailed in the Privacy Policy.
16. Non-Disparagement
You agree not to engage in any conduct or communication, whether public or private, intended to disparage Live Your Dream Club or its representatives. This includes any remarks, comments, information, or statements that could be construed as derogatory, defamatory, libelous, or slanderous. You further agree not to make any statements that may harm the reputation of Live Your Dream Club or its affiliates in any manner.
17. Binding Effect
This Agreement is binding upon both parties and their respective successors, heirs, and permitted assigns. The Agreement is non-transferable, and you may not assign or transfer your membership in Live Your Dream Club to any other person or entity without prior written consent from the Club.
18. Termination
Live Your Dream Club is committed to providing a positive experience for all members. However, if you fail to comply with any provisions of this Agreement, the Club may, at its discretion, limit, suspend, or terminate your membership without refund or forgiveness of any payments. Your obligations under this Agreement will survive its expiration or termination.
19. Changes
The Club reserves the right to modify this Agreement at any time, imposing new or additional terms. Any changes will be effective immediately and incorporated into this Agreement. Continued use of Live Your Dream Club signifies your acceptance of any modifications. We will notify you of any significant changes via email or accessible areas on the website.
20. Indemnification
You agree to defend, indemnify, and hold harmless Live Your Dream Club and its affiliates from any liabilities, expenses, claims, damages, or costs that arise from your breach of this Agreement or misuse of the Club. This includes defending the Club in any legal actions or regulatory matters.
21. Binding Arbitration
In the event of a dispute arising from this Agreement or your participation in Live Your Dream Club, either party may elect to resolve the dispute through binding arbitration under the Federal Arbitration Act (FAA). Arbitration will be conducted according to JAMS rules and in the State of New York.. This excludes the right to litigate in court, except in small claims court or for the enforcement of an arbitration award.
22. Class Action Waiver
Any arbitration or proceeding will be limited to the dispute between you and Live Your Dream Club individually. You waive any right to bring claims as part of a class action or representative proceeding.
23. Equitable Relief
In the event of a breach or threatened violation of the Club’s intellectual property rights or confidential information, the Club may seek injunctive relief from any court having jurisdiction to protect its interests, without waiving other remedies under this Agreement.
24. Entire Agreement
This Agreement constitutes the entire understanding between you and Live Your Dream Club and supersedes all prior agreements, written or oral, regarding the subject matter of this Agreement.
25. Compliance with Law
Both parties agree to comply with all applicable laws in performing their obligations under this Agreement. In case of any conflict between the provisions of this Agreement and any applicable law, the applicable law shall prevail.
26. No Waiver
Failure by either party to insist on the performance of any obligation does not waive the right to require that obligation in the future. Waiver of any breach shall not be deemed a waiver of any other breach.
